EU PPWR Is Live: The Packaging Documents Personal-Care Buyers Now Need

On 12 August 2026 the EU Packaging and Packaging Waste Regulation — PPWR, Regulation (EU) 2025/40 — became fully applicable. It is not an update of the old 94/62/EC directive. It is a regulation, which means it applies identically in all 27 member states with no national transposition and no opt-outs.

If you place packaged personal-care products on the EU market, the first thing to understand is that liability sits with you, not with your bottle supplier. A supplier's assurance is not a legal defence. What market surveillance authorities will ask for is a document set that you hold and can produce on request.

What Actually Changed on 12 August 2026

  • Declaration of Conformity per packaging type. Drawn up and signed by the manufacturer, held by the importer, backed by a technical file.
  • Importer verification duty under Article 18(2). You must verify that the conformity assessment was actually carried out — not merely receive a PDF.
  • Heavy metals limit. Lead, cadmium, mercury and hexavalent chromium combined must stay at or below 100 mg/kg in the packaging.
  • PFAS restriction in food-contact packaging. Total fluorine below 50 mg/kg is treated as compliant; above that, further testing is required.
  • EPR registration in each member state where packaging is first placed on the market. Non-EU sellers need an authorised representative inside the EU.
  • Packaging minimisation applies now. "Marketing needs" is explicitly not accepted as a reason for extra material.

There is no grace period for goods already in transit. Packaging placed on the market on or after 12 August 2026 must comply regardless of when it was produced.

The Most Common Misreading: PFAS and Cosmetic Bottles

A shampoo or body-wash bottle is not food-contact packaging, so the PFAS provision does not bite in the same way. That does not make your bottle unregulated. The heavy-metals limit applies to all packaging, and the Declaration of Conformity and technical file obligations apply to a labelled cosmetic bottle exactly as they apply to a food tray.

The trap is the outer transit carton. PPWR regulates packaging, not products. Your master cartons, dividers and shrink film are in scope even when the bottle itself is fully compliant.

Five Documents to Collect, Per Packaging Type

Note the unit: per packaging type, not per SKU. A catalogue of 400 bottles sharing closures, resin family and carton format may collapse into a handful of declarations.

The 2030 Deadline Is the One to Design For Today

Recyclability grading arrives on 1 January 2030. From that date only grades A to C may be placed on the market — meaning at least 70% recyclability — and recycled content minimums begin. From 2038, grades D and E disappear entirely and only A or B remain marketable.

In practical terms, the specification decisions that will decide your 2030 grade are being made in your 2026 purchase orders. Three matter most for blow-moulded personal-care bottles:

  • Single-material construction. An HDPE bottle with a PP pump and a PVC label is a grading problem. A mono-material closure such as our CP-2401 PP lotion pump is the low-effort fix.
  • Recycled content headroom. Contact-sensitive plastic packaging other than PET needs 10% post-consumer recyclate by 2030; contact-sensitive PET needs 30%. Only post-consumer material counts — post-industrial does not.
  • Decoration that survives washing. Heavily inked or metallised decoration can push a bottle down a grade on its own.
Ask for recycled content in writing, and ask whether the figure is post-consumer or post-industrial. Suppliers routinely quote the two together because the larger number sounds better. Only one of them counts toward PPWR.

How to Ask Your Bottle Supplier

Send this list and you will learn quickly whether a supplier understands the regulation or is improvising:

  • Can you issue a Declaration of Conformity per packaging type, or only a general letter?
  • Do you hold a heavy-metals test report for the bottle, the closure and the carton?
  • Is a PFAS statement available, even though cosmetics do not strictly require one?
  • What post-consumer recycled content can you hold consistently, and what does it do to the surface finish?
  • Can you supply the same bottle in a mono-material closure configuration?

The Short Version

PPWR did two things at once. It moved the burden of proof onto whoever places packaging on the EU market, and it started a clock that will eliminate poorly designed packaging by 2038. The first is paperwork you can collect this quarter. The second is a design decision to make in your next mould order — because moulds outlive regulations.
